LIABILITY WAIVER, ASSUMPTION OF RISK, & RELEASE AGREEMENT
Liability Waiver, Assumption of Risk, & Release Agreement
This Agreement is entered into by and between Discovering Alchemy, LLC, a Washington State limited liability company ("Company"), and you ("Participant").
By purchasing, accessing, or participating in Unleash Your SPIRIT or any other program offered by Discovering Alchemy, including all courses, programs, recordings, live calls, workshops, written materials, community spaces, and events (collectively, the "Program"), you acknowledge and agree to the following:
1. EDUCATIONAL PURPOSE ONLY — NO PROFESSIONAL SERVICES
The Program is provided solely for educational and informational purposes.
The Company does not provide medical, mental health, psychological, psychiatric, nutritional, or other licensed professional services. Scotty Rice is not a licensed therapist, psychologist, or medical professional. Nothing in the Program constitutes or creates a professional-client relationship, and nothing herein should be interpreted as medical advice, diagnosis, treatment, therapy, or healthcare.
You understand that:
Breathwork, movement, meditation, nutrition discussions, and relationship frameworks are not substitutes for professional care
Any information shared reflects general education and personal experience, not individualized professional instruction
2. ASSUMPTION OF RISK
You acknowledge that participation in the Program involves inherent risks, including but not limited to:
Physical injury, strain, or discomfort
Shortness of breath, dizziness, tingling, emotional release, or temporary loss of consciousness
Psychological or emotional distress
Aggravation of pre-existing physical, mental, or emotional conditions
You voluntarily assume full responsibility for all risks associated with your participation, whether known or unknown, foreseeable or unforeseeable.
3. BREATHWORK & SOMATIC PRACTICES — SPECIFIC ACKNOWLEDGMENT
You understand that breathwork, nervous-system practices, somatic movement, and embodiment exercises can produce intense physiological and emotional responses.
You affirm that:
You will never force your breath
You will immediately stop if you feel unsafe
You are solely responsible for modifying or discontinuing any practice
You will consult a licensed healthcare provider before participating if you have any medical or mental health conditions that could be affected
You specifically acknowledge that breathwork carries a risk of dizziness or temporary loss of consciousness. You agree to NEVER practice breathwork in or near water, while driving, while operating machinery, or in any position where a loss of consciousness could result in serious injury or death.
You accept full responsibility for any outcomes related to breathwork or somatic practices.
4. PERSONAL RESPONSIBILITY & SELF-DIRECTED PARTICIPATION
You acknowledge that:
You choose how and whether to apply the information provided
You are responsible for your own decisions, actions, and results
The Company cannot monitor how you practice or apply the material
All participation is voluntary and self-directed
5. RELEASE OF LIABILITY
To the fullest extent permitted under Washington State law, you hereby release, waive, discharge, and hold harmless Discovering Alchemy, LLC, its owners, employees, contractors, facilitators, and affiliates from any and all claims, demands, damages, injuries, losses, or liabilities of any kind arising from or related to your participation in the Program.
This release includes claims based on:
Ordinary negligence
Misuse or misunderstanding of Program materials
Failure to seek or follow professional guidance
Nothing in this Agreement releases the Company from liability for gross negligence, willful misconduct, or fraud.
6. NO GUARANTEES
You acknowledge that:
Results vary by individual based on effort, background, and personal circumstances
No specific outcomes, transformations, or relationship results are guaranteed
Testimonials reflect individual experiences and are not promises of results; individual results are not typical
7. MEDICAL & MENTAL HEALTH DISCLAIMER
You confirm that you are either:
Physically and mentally capable of participation, OR
Have consulted with and received approval from a licensed healthcare professional prior to participation
If you are currently experiencing a mental health crisis, suicidal ideation, or acute psychiatric episode, you agree to discontinue participation immediately and contact a licensed professional or crisis line for support.
If you experience severe physical or emotional distress at any point, you agree to stop participating and seek appropriate professional assistance.
8. INDEMNIFICATION
You agree to indemnify and hold harmless Discovering Alchemy, LLC from any claims, damages, or legal expenses arising from:
Your participation in the Program
Your actions or decisions related to the Program
Your violation of this Agreement
9. MODIFICATIONS
The Company reserves the right to update or modify this Agreement at any time. Changes will be reflected by an updated date on this page. Your continued participation in any Program following such changes constitutes your acceptance of the revised Agreement.
10. SEVERABILITY
If any provision of this Agreement is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
11. GOVERNING LAW & VENUE
This Agreement shall be governed by the laws of the State of Washington, without regard to conflict-of-law principles. Venue for any dispute not subject to arbitration shall lie exclusively in the courts of Washington State.
12. ACKNOWLEDGMENT & ELECTRONIC AGREEMENT
By purchasing, accessing, or participating in the Program, you acknowledge that:
You are at least 18 years old
You have read and fully understood this Agreement
You voluntarily agree to be legally bound by its terms
Your electronic acceptance at the time of purchase constitutes a legally binding signature.
We take your safety seriously. These agreements exist to protect you and to ensure you are fully informed before we do this work together.
