LIABILITY WAIVER, ASSUMPTION OF RISK & RELEASE AGREEMENT
This Agreement is entered into by and between Discovering Alchemy, LLC, a Washington State limited liability company (“Company”), and you (“Participant”).
By purchasing, accessing, or participating in Unleash Your SPIRIT or other programs related to Discovering Alchemy, including all courses, programs, recordings, live calls, workshops, written materials, community spaces, and events (collectively, the “Program”), you acknowledge and agree to the following:
1. EDUCATIONAL PURPOSE ONLY – NO PROFESSIONAL SERVICES
The Program is provided solely for educational and informational purposes.
The Company does not provide medical, mental health, psychological, psychiatric, nutritional, or other licensed professional services. Nothing in the Program constitutes or should be interpreted as medical advice, diagnosis, treatment, therapy, or healthcare.
You understand that:
Breathwork, movement, meditation, nutrition discussions, and relationship frameworks are not substitutes for professional care
Any information shared reflects general education and personal experience, not individualized instruction
2. ASSUMPTION OF RISK
You acknowledge that participation in the Program involves inherent risks, including but not limited to:
Physical injury, strain, or discomfort
Shortness of breath, dizziness, tingling, emotional release, or loss of consciousness
Psychological or emotional distress
Aggravation of pre-existing physical, mental, or emotional conditions
You voluntarily assume full responsibility for all risks, whether known or unknown, foreseeable or unforeseeable.
3. BREATHWORK & SOMATIC PRACTICES – SPECIFIC ACKNOWLEDGMENT
You understand that breathwork, nervous-system practices, somatic movement, and embodiment exercises can produce intense physiological and emotional responses.
You affirm that:
You will never force your breath
You will immediately stop if you feel unsafe
You are solely responsible for modifying or discontinuing practices
You will consult a licensed healthcare provider if you have any medical or mental health conditions that could be affected
You accept full responsibility for any outcomes related to breathwork or somatic practices.
4. PERSONAL RESPONSIBILITY & SELF-DIRECTED PARTICIPATION
You acknowledge that:
You choose how and whether to apply the information
You are responsible for your own decisions, actions, and results
The Company cannot monitor how you practice or apply the material
All participation is voluntary and self-directed.
5. RELEASE OF LIABILITY
To the fullest extent permitted under Washington State law, you hereby release, waive, discharge, and hold harmless Discovering Alchemy, LLC, its owners, employees, contractors, facilitators, and affiliates from any and all claims, demands, damages, injuries, losses, or liabilities of any kind arising from or related to your participation in the Program.
This includes claims based on:
Ordinary negligence
Misuse or misunderstanding of Program materials
Failure to seek professional guidance
6. NO GUARANTEES
You acknowledge that:
Results vary by individual
No outcomes, transformations, or relationship results are guaranteed
Testimonials are not promises of results
7. MEDICAL & MENTAL HEALTH DISCLAIMER
You confirm that you:
Are physically and mentally capable of participation or
Have consulted with and received approval from a licensed professional
If you experience severe physical or emotional distress, you agree to discontinue participation and seek professional assistance.
8. INDEMNIFICATION
You agree to indemnify and hold harmless Discovering Alchemy, LLC from any claims, damages, or legal expenses arising from:
Your participation
Your actions
Your violation of this Agreement
9. GOVERNING LAW & VENUE
This Agreement shall be governed by the laws of the State of Washington, without regard to conflict-of-law principles. Venue shall lie exclusively in Washington State.
10. ACKNOWLEDGMENT & ELECTRONIC SIGNATURE
By purchasing, accessing, or participating in the Program, you acknowledge that:
You are at least 18 years old
You have read and understood this Agreement
You voluntarily agree to be legally bound
Your electronic acceptance constitutes a legally binding signature.
